Farm Share solicits donations of surplus
food for distribution to charities that feed the needy. In accordance
with IRS regulations, we maintain records of all donations.

In 1996, the Good
Samaritan Food Donation Act was passed by the Federal Government
encouraging donation of food and grocery products to non-profit
organizations, such as Farm Share, for distribution to needy individuals.
It protects donors from liability for donated food items.

This
law enables you to donate your produce and other food to Farm Share
without worrying about liability.
- You are protected from liability when you
donate to Farm Share.
- You are protected from civil and criminal
liability should the product donated in good faith later cause
harm to the recipients.
- Congress recognized that the donation of
food near to the date of recommended retail sale is, in and of
itself, not grounds for finding gross negligence. For example,
you can donate food stamped close to expiration date for retail
sale.

You will receive an IRS approved tax donation
receipt.
- You will save disposal fees and related
labor costs.
- You will have the potential to increase
sales as a result of product exposure and positive publicity.
- Your surplus can be donated and distributed
to the needy without interfering with your normal marketing channels.
- You will have the satisfaction of knowing
that you are helping others.
Your donation is accepted
as follows:
- Food items will not be sold, bartered or
exchanged for other products or services.
- Items will be used only in a manner related
to the tax-exempt purpose of Farm Share.
- All items will be used to aid agencies feeding
hungry people in compliance with Federal Guidelines.
